General terms and conditions

GENERAL RECOMMENDATION

If you are interested in reserving our premises, please announce the course of the event in advance.
Before making a non-binding offer, a viewing appointment is often a great advantage. Together, you can discuss the event in detail and exchange ideas on site.

Reservations for groups in the restaurant area.

For table reservations at Restaurant Bolena for 5 people or more, a
Down payment - any exceptions to this can be agreed by email.

If you cancel a table (5 people or more) within 96 hours before the agreed reservation time, we reserve the right to charge €35, - cancellation fees per person. The same rules apply in the event of a “no show”.

Reservation for special events & menus

For cancellations at Restaurant Bolena on special occasions and/or special menus (in particular Valentine's Day, New Year's Eve, Chef's Choice, Vienna Restaurant Week and Genusswochen menus) within 24 hours before the agreed reservation time, we reserve the right to charge €35, - cancellation fees per person. The type of reservation (by telephone, in writing, online, reservation portal, etc.) is irrelevant. The same rules apply in the event of a “no show”.

Duration of use of the premises?

Hourly rental is possible, in which case the minimum usage period is 3 hours. In any case, the curfew must be observed. The approximate end of the event must be announced in advance; compliance is desirable.

How is dismantling regulated?

The organizer/tenant has sufficiently informed himself about the condition of the premises and their suitability for the intended use. The time frame for assembly and dismantling work must be clarified with Bolena in advance and depends on the availability of the rooms. Please refer to the offer for the prices provided for this purpose.

If the agreed dismantling times are exceeded, Bolena is entitled to have the structures removed and stored at the expense and risk of the tenant/organizer. After dismantling, the original state must be restored. The lesseer/organizer must compensate Bolena for damage caused by improper handling.

The tenant/organizer is obliged to notify Bolena of the intended installation of decorative material or other objects and to obtain his consent. The function rooms must not be damaged.

When installing decoration, fire police and other regulations must be complied with in accordance with the operating system. Penalties resulting from failure to comply with these regulations are borne in full by the tenant/organizer. All costs associated with production and dismantling are borne by the organizer. Bolena assumes no liability for damaged or lost decorative material.

Reservation confirmation

By confirming by email or depositing a deposit, the organizer/tenant undertakes to rent the premises and accepts the general terms and conditions in full. The payment of a deposit must be confirmed either by bank transfer or with written, signed and stamped confirmation. As soon as a confirmation is received by e-mail, the agreed date is already confirmed.

Storno

In the event of cancellation at the request of the organizer/tenant of a booked event, the tenant/organizer may be charged cancellation fees.

Cancellations:

- From receipt of the booking confirmation by email: €300, -

- up to 6 weeks before your event 50% of the booked turnover

- up to 4 weeks before your event 75% of the booked turnover

- 100% of the booked turnover will be charged up to 2 weeks before your event.

If no exact amount is foreseeable for events, the fee per capita consumption of €25, - will be charged, but at least the minimum consumption agreed in writing by e-mail. The planned number of guests is based on the organiser's initial information. When data is between two values, an average value is used. If there is no information at all regarding the planned number of guests, it is assumed that there are 60 people.

Cancellations due to official measures (e.g. lock-down) are always free of charge for the tenant/organizer. In this case, the deposit will be refunded in full and there will be no cancellation fees. Alternatively, the event can be postponed to another date.

Different regulations are possible but must be recorded in writing in any case.

Beverage statement

If no other agreement has been made, the drinks will be charged according to actual consumption. The organizer acknowledges the calculation of beverage consumption by Bolena, which is based on actual consumption. Package offers are possible and can be agreed individually in writing.

Events after the agreed (event) times?

For each hour after the agreed event times, we reserve the right to charge up to €150 per additional hour. Different regulations are possible and can be agreed individually.

Food and drinks brought by the organizer.

Bringing food and drinks requires express permission from Bolena. Bolena charges a lump sum/stubble money to be determined at its discretion.

Musical performance

Should the organizer plan musical performances during the event, he is obliged to provide Bolena with the details in good time. The requirements according to the operating system must be met.

Signage

We are happy to provide our logo to announce the event through posters, flyers, newsletters or directions to Bolena. This is available on request and may only be used as an original logo and by appointment.

Scouring

In principle, the costs for final cleaning are included in a flat rate when booking. Comprehensive special cleaning, if considered necessary by Bolena, will be charged separately. In particular, this includes cleaning disgusting substances (vomit, faeces) and cleaning the sidewalk in front of and next to the restaurant.

If it is not possible to clean various items, the organizer is liable for himself and his guests and bears the full costs of the renovation or new purchase.

Statutory charges

All taxes, fees, duties, in particular sales tax, are borne by the organizer/tenant. All prices shown are gross prices.

Permits

The organizer/tenant must obtain official or other permits for the planned event himself at his own expense and risk and, if necessary, prove these to Bolena before the start of the event. Bolena must be held indiscriminate in this regard.

Force majeure

If the event cannot be carried out due to force majeure, strike, political events or other important reasons that were brought about by Bolena neither intentionally or grossly negligently, claims for compensation by the tenant/organizer against Bolena of any kind are excluded.

Liability and compensation

The tenant/organizer is liable for damage caused by his guests, employees or agents. If necessary, Bolena will require the lessant/organizer to take out appropriate insurance. Bolena is only liable if damage was caused intentionally by its own employees. Bolena assumes no liability for theft, loss or damage to goods brought in or left behind by the tenant/organizer or third parties, as well as wardrobe.

Tenant/organizer advertising

Advertising measures in image, sound and writing require the express written consent of Bolena.

Filming and photography

As part of the event, the tenant/organizer is allowed to make or have films, photographs, drawings or other illustrations made. Bolena is allowed to produce films and photographs, etc. for its own advertising purposes in coordination with the organizer.

Data protection

The tenant/organizer gives his express consent that the personal data of the tenant/organizer provided to Bolena may be processed and used for direct marketing purposes within the framework of Bolena's legal provisions. The tenant/organizer agrees to the sending of mail for advertising purposes.

Written and customary law

Amendments, additions and additions must be made in writing. Additional oral agreements are ineffective. The tenant/organizer cannot derive rights of any kind from previous contracts with Bolena.

Termination by Bolena

Bolena is entitled to terminate the contractual relationship for good cause with immediate effect and without giving detailed reasons, in particular if:

• The event jeopardizes smooth business operations

• The reputation and safety of the home is endangered

• In case of force majeure

• For private events at least 48 hours before the event, no proof of payment of a down payment according to the offer can be proven. Under no circumstances is the organizer/tenant entitled to assert claims for damages arising from the title of termination, unless the contract was terminated without reason of dissolution as a result of intentional conduct by a representative of Bolena.

Invoicing

Unless otherwise agreed, the invoice will be issued on the day of the event. In the case of package offers, the invoice is always sent by email as a PDF afterwards. Invoices are payable within 7 days from the date of the invoice without deductions. If the payment deadline is exceeded, we charge 14% per annum default interest.

Judicial venue performance provision

Only Austrian law applies, with the exception of conflict of law rules. The place of jurisdiction and fulfilment for both parties is Vienna. The invalidity of individual conditions of participation does not affect the validity of the remaining provisions. The contract is therefore not terminated.
